Terms and Conditions for Wallores Gallery
1. Acceptance of Terms
By accessing and using Wallores Gallery (the “Website”) and purchasing downloadable artwork (the “Artwork”), you agree to be bound by these Terms and Conditions (the “Terms”). If you do not agree to these Terms, please do not use the Website or purchase the Artwork.
2. License and Use of Artwork
Subject to these Terms, Wallores Gallery grants you a non-exclusive, royalty-free license to use the Artwork for personal, non-commercial purposes only.
3. Permitted Uses
Permitted uses of the Artwork include:
- Displaying the Artwork in your home or business.
- Using the Artwork as a screensaver or background image on your personal devices.
4. Prohibited Uses
You may not:
- Resell, sublicense, or otherwise distribute the Artwork, whether in its original form or as part of a derivative work.
- Use the Artwork in a way that is defamatory, obscene, or infringing on the rights of others.
- Remove any copyright notices or watermarks from the Artwork.
- Use the artwork in a manner that implies an association with or endorsement by Wallores Gallery.
5. Copyright
All copyright and other intellectual property rights in the Artwork remain the sole property of Wallores Gallery.
6. Disclaimer of Warranties
The Artwork is provided “as is” and without any warranties, express or implied. Wallores Gallery disclaims all warranties, including but not limited to, implied warranties of merchantability and fitness for a particular purpose.
7. Limitation of Liability
In no event shall Wallores Gallery be liable for any damages, including but not limited to, direct, indirect, incidental, special, or consequential damages, arising out of or in connection with your use of the Website or the Artwork. Wallores Gallery’s liability shall be limited to the amount you paid for the Artwork.
8. Termination
Wallores Gallery may terminate your access to the Website and the license to use the Artwork if you violate these Terms.
9. Modification of Terms
Wallores Gallery reserves the right to modify these Terms at any time without notice. It is your responsibility to review these Terms periodically for changes. Your continued use of the Website following the posting of changes constitutes your acceptance of the revised Terms.
10. Dispute Resolution
Any disputes arising out of or in connection with these Terms shall be resolved as follows:
- For purchases made through Etsy, you should first contact Etsy’s customer support.
- For purchases made through Spreadshirt, you should first contact Spreadshirt’s customer support.
- As a last resort, you may contact Wallores Gallery directly.
11. Refund Policy
Due to the nature of downloadable digital products, Wallores Gallery does not offer refunds except in cases of proven fraudulent activity (e.g., stolen credit card). Refund requests based on fraudulent activity must be accompanied by substantial proof and will be handled by Etsy. Spreadshirt has a 90 day return policy. Customers can contact Spreadshirt first using the order confirmation received.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Michigan, without regard to its conflict of law provisions.
